Subclass 491 Skilled Work Regional (Provisional) Visa
Subclass 491 is a provisional visa and granted for 5 years. The holders of this visa must be live, work, and study in a regional area for 3 years.
With this visa you can
- From the visa grant date applicant stay in Australia for 5 years.
- You must live, work and study in a designated region of Australia.
- You can travel to and from Australia as many times as you want, while the visa is valid.
- Once certain residence requirements have been met, holders can apply for a permanent residency visa.
- Eligible for Medicare card.
Visa Criteria
In order to qualify for a Subclass 491 visa, you would need to :
- You must lodge an EOI to get invited.
- You must be nominated by a State or Territory Government.
- You must meet the minimum skilled migration points 65.
- Age must be between 18 and 44 inclusive.
- You must have a positive skill assessment in your occupation.
- Your occupation must be in the skill occupation list.
- Have Competent English or higher or holder of valid passports.
- Meet health and character requirements.
To apply for Skilled nominated subclass 491, required to lodge an Expression of Interest through Skill selection and invited by the department of immigration. You must lodge the invitation with in 60 days from the invitation.
Nomination or Sponsorship by State or Territory Government
Each State and Territory Government publish a list of occupations in short supply in their area. Each state and territory have specific requirements in terms of work experience, English language ability or specialised skills.
Sponsorship from an Eligible Family Member
Applicants through the family-sponsored pathway can only nominate occupations on the MLTSSL. The sponsor must be usually resident in a designated regional area of Australia, and be:
- At least 18 years of age.
- An Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen.
- An eligible relative; including parents, children, siblings, aunt/uncle, nephew/niece, grandparent, or first cousin.
Who can be included in this visa?
You can include the following family members in your application:
- Spouse or defacto partner (including same-sex spouse/partner).
- Dependent children.
It is possible to include partners and dependent children after lodgement of the application but before finalizing the visa.
Duration and Conditions
Subclass 491 visa is a Provisonal visa with full work rights. If you are outside Australia when the visa is granted, you and your family members will need to enter Australia for the first time prior to expiry of time frame given in the visa grant letter. You would generally be expected to live, work and study in regional area for 3 years.
Conversion to Permanent Residency
It is possible to apply for a subclass 191 permanent residence (Skilled Regional) visa after living and working in a regional area for at least 3 years. Applicants must meet certain income requirements and be able to prove their residence in regional Australia for the 3 year period.
